The One-Stop-Shop for Starting a Business
The opening of the One-Stop-Shop for Starting a Business falls within a broad program to reform the business climate in Mali, which has been initiated by the Government, through the Ministry of Industry, Investment and Trade and the Investment Promotion Agency of Mali (API-Mali). The objective of the program is to increase national and foreign direct investments (FDI).
It is within this context that the Government of Mali adopted Decree (No.08-276/P-RM) on May 13 2008, which defines the administrative formalities for starting a business at the One-Stop-Shop in the Investment Promotion Agency of Mali (API-Mali). The decree was amended in the Cabinet Meeting of Wednesday, May 6th 2009 by adding, in particular, the possibility for the One-Stop-Shop to complete the formalities for starting a business within 72 hours.
The One-Stop-Shop for starting a business is:
- A place and single contact for starting a business,
- A time effective tool, which allows users to start a business within 72 hours from the date of submission of the application file,
- Transparency in the administrative procedures and costs incurred in starting a business,
- Registry for the Trade and Property Credit (RCCM) on the basis of a declaration of oath, which will be validated upon the submission of a police record within two (2) months,
- Publication of an appropriate legal notice in the newspaper within 24 hours,
- Access to legal notices on API-Mali Website.
Functioning of the One-Stop-Shop for Starting a Business:
The One-Stop-Shop for Starting a Business comprises two (2) services:
The Front Office: is responsible for receiving, informing and directing investors as regards to formalities in starting a business, as well as making appointments with notary offices and other government services.
The Back Office: contains all government services in the starting-a-business chain:
The taxation representative: To register the articles of association,
The representative of the Trade and Property Registry (RCCM): To issue the registration certificate required by the OHADA texts,
The representative of the National Identification Number (NINA): For “post-creation” declarative formalities.
Procedure for starting a business
The procedure for starting a business in Mali is limited to some simple formalities to be fulfilled at the One-Stop-Shop of API-Mali in accordance with the Government Decree. It is as follows: the future businessman or his representative goes to the One-Stop-Shop for Starting a Business with the required documents, depending on the type of business he wants to set up and follows the procedure below:
The One-Stop-Shop for Starting a Business is an information office in which business operators can obtain all information on starting a business.
Time taken to start a business
Since the opening of the One-Stop-Shop, shorter time frames have been introduced for processing documents so as to improve the business environment in Mali.
The time frame for the One-Stop-Shop for Starting a Business is seventy-two (72) hours.
